ACS Technologies Group, Inc., and its affiliates, their officers, directors, employees, or agents (collectively referred to as “ACST“) creates software solutions to help churches, schools, and organizations fulfill their missions. You may be a visitor (“Visitor“) to our websites (“Websites“) or a customer (“Customer” or “Licensee”) who purchased or is using our products and services (collectively, “Services“).

We have a direct relationship with Customers that have created an account or a site with us and pay for our Services (e.g. denominational alliances, diocese, organizations, churches, parishes). These Customers may share licensed access to their account or site with authorized churches, organizations, or individuals. They are all considered our Customers, but we have different responsibilities to those with whom we have direct relationships. We’ll specify when we’re referring to particular kinds of Customers, otherwise we’ll refer to “you” generally.

Our Services are designed to help our Customers manage administrative duties, provide demographic data to plan for growth, and communicate with each other in a secure, online environment (e.g. chat, messaging, email, or by sharing posts and events).

ACST is proud of the software, images, videos, typefaces, graphics, music, sounds and other material (collectively “ACST Intellectual Property and Content”) we produce and we have a great deal of respect for content that belongs to others. Please take the time to review our Terms of Service and Intellectual Privacy Policy policies to learn when you can share ACST Intellectual Property and Content while using our Services.

Information We Collect and How We Use It

This policy describes the information ACST collects and the circumstances that we might use or disclose that information. We consider ACST to be the Custodian of all data that is entered in our Services, including Customer and Visitor data collectively referred herein as “Customer Data”). We do not own any Customer Data provided and therefore, have no right to resell it. We do not approve of the practice of selling phone numbers or other data to third-parties and do our best to ensure that our Customer Data is protected from this practice. ACST will use Customer Data for the reasons it was provided to us, or for reasons that are otherwise allowed by law. For example, we use it to:

  • place and process orders,
  • process payments, and
  • perform accounting related tasks for billing or credit checks.

We may also collect financial data so that we can extend credit to our Customers to sell our Services to you. A Customer’s financial data is only used to process transactions and evaluate your credit. As a normal business practice, we review our Customers’‘ credit periodically — as long as their account is active. We also report Customer account status and payment history to various credit reporting agencies.

Collection and Use of Personal Information

We collect financial data from our Customers and their guests . You may provide financial information so that we can extend credit to you or sell our Services to you. Your financial data is only used to process transactions and evaluate your credit. As a normal business practice, we review your credit periodically — as long as an account is active. We also report Customer account status and payment history to various credit reporting agencies. We also gather anonymous statistics when you watch videos hosted by a third-party. We like to know when you stopped watching or if we successfully kept you engaged. This information helps us create better videos for you.

Cookies and Other Technical Information

We use cookies on our Web-based Services and Websites to collect data from Customers and Visitors. General data includes the operating system and IP address you used, the pages you viewed, as well as which browser and version were used. Examples of personal data include your name, site number, identification number, mailing address, email address, and other personal characteristics or attributes that identify you.

Cookies allow us to secure and confirm your identity when you log into our software or visit our websites. They make a record of your activity and help you remember your Internet preferences.

ACST uses tracking pixels (also known as web beacons) on our Websites to track Visitor activity. Tracking pixels can tell us which operating system, mobile device, browser you use, as well as your IP address and other information we use to enhance your experience.

We also gather anonymous statistics when you watch videos hosted by a third-party. These statistics can tell us when you stopped watching or if we successfully kept you engaged. This information helps us make better videos for you.

Third-party Cookies

When using our Web-based Services or Websites, you may watch embedded videos on a third-party site, visit or make a payment with a third-party payment processor. These third-party companies use their own cookies to collect information about your online behavior, demographics, and deliver a more personalized experience to you. ACST does not have control over the placement or use of cookies by third-parties. Cookies are added to improve your experience. If you choose to disable cookies in your browser, you may not have the best experience.

Transport or Deletion of Data

If a Customer requests to cancel their account or site, their data may be permanently deleted from our servers.Customers should remove and safeguard all of their organization’s data, before requesting to delete their account. If this doesn’t happen, further access to their account or site may not be possible. We will also disconnect any connection we had established to your account information and delete all account credentials.

Some portions of Customer Data, including aggregate data related to analytical research, benchmarking, and performance tracking (among others) may remain on our servers on a backup server or in media indefinitely. Use of Aggregate Data

ACST may compile or aggregate information that is not personally identifiable to our Visitors and/or Customers, meaning that it won’t contain any Personally Identifiable Information (“PII”), or be capable of identifying any one person.

PII is information that can be used on its own or with other information to identify, contact, or locate someone else. PII has different definitions based on the state law or federal regulation. Typically, it must include someone’s first name and last name, in combination with one or more of these elements: social security number, date of birth, driver’s license, address, email address, checking account number, or credit/debit card number + CVV and/or PIN. Please check with your state for more information regarding PII.

The intent of this larger, de-identified dataset is to have representative demographic, statistical data. Such data may be used by ACST and our third-party providers to conduct certain analytical research, marketing, performance tracking, and benchmarking. We may publish summary or aggregate results relating to metrics constructed from such data and distribute or license such de-identified, aggregated data for various purposes, provided that all underlying identities are protected.

Do Not Track

Do Not Track (“DNT”) is an optional browser setting that allows you to express your preferences regarding tracking by advertisers and other third-parties. We do not currently respond to DNT signals. Therefore, please be advised that third-party web analytics companies may collect information about your online activities over time and across our website and other online properties.

Special Data Requirements

If a Customer has special requirements regarding the data transport or deletion of their account or site, please send us a written request to the address provided at the end of this page. Upon consideration, we may be able to accommodate your needs, however an additional charge may be warranted.

Specifically to our Canadian Customers who must meet national data standards, our Services will help you comply with relevant privacy laws.

Accounts, Passwords, and Security

We use CAPTCHA technology to keep our Customers’ experience with our Web-based Services secure from bots, spam, and abuse. If a Customer opens an account or a site while using our Websites and/or Services, they’ll create a login with a user ID and password to register or sign in. If a Customer (e.g. the church or organization) allows a congregant or an individual to create an account and/or a login, the administrator may be able to disable the login, and other terms may apply.

  • When using our Websites and/or Services, you agree to provide true, accurate, current, complete registration information about yourself, and keep that information updated. If we suspect that you’re providing false information, we reserve the right to suspend or terminate your account or site.
  • By creating an account or site, you agree to receive all required notices electronically, to the email address you indicated. If the email address we have on file for you is no longer valid or used, it is your responsibility to update us with the correct email address.
  • You also agree to close your account or site at the end of each session and notify the administrator of any unauthorized use of your login or any other security breach. We cannot and will not be liable for any loss or damage arising from your failure to comply.

Protecting the confidentiality of your login is very important. While password criteria may differ among our ServicesACST requires the use of “strong passwords” with strict criteria in place to prevent others from learning your password.

  • You’re responsible for maintaining the confidentiality of your account or site and all activities that occur under your login. We recommend that you change your password periodically.
  • You may not share your login with any third-party. If you believe that your login has been stolen or is known to others, you must change your password immediately. We are not responsible if someone else accesses your account or site through information they have obtained from you.

Communication and Communication Preferences

ACST reserves the right to contact you about updates or changes regarding your account and/or Services, and to advise you about events that may affect your ServicesCustomers are responsible for making sure we have the correct contact information to reach you. Email Communications

From time to time, we’ll email promotional announcements, program updates, and software launch information to our CustomersTo stop receiving promotional announcementsCustomers may unsubscribe at the bottom of any email at any time. This opt-out option applies to promotional communications only. Additionally, some of our Services may send system emails to Customers. As a security measure, the information provided is not linked to any information that can identify any individual.

In-product Communications

ACST uses a third-party software in some of our Services to inform you about the latest product enhancements, changes in the software industry that may affect your experience, or remind you about a deadline. Some Services allow Customers to communicate with others who use their account or site in a secure, online environment via chat, messaging, email, or by sharing posts and events.

Blogs and Other Forums

If you’ve ever posted comments, blogged, or tweeted anything referencing ACST or our Services – any information you provided can be read, collected, or used to send you unsolicited messages. While some of these forums may be hosted by us, our Customers, or a third-party service provider on our behalf, ACST is not responsible, or liable to any Customer or third-party, for the substance or accuracy of any information or material posted.

Customer Proprietary Network Information (CPNI)

Higher Ground Managed IT, a division of ACST, is a Voice over Internet Protocol (VOIP) telecommunications provider and has access to our CPNI data. CPNI data includes phone numbers, the time calls are placed, the length and location of calls, cost and billing of calls, service features, and premium services, such as call directory assistance. ACST also collects various anonymous information, including the number of lines you have, the features you use, your monthly usage, systems service and/or performance metrics. This generic information helps us to provide and/or improve the Services we offer.

How we use CPNI data

ACST does not use CPNI data for advertising or marketing purposes. ACST does not use, disclose, share, or grant access to CPNI except as permitted or required by law. ACST is required to share CPNI data with other telecommunications providers for network operating purposes. For example, if you decide to sign up for another phone provider, your relevant CPNI data would automatically be shared with the new provider. ACST uses telecommunications provider industry-accepted technologies to safeguard CPNI data. Under federal law, you have the right, and we have the duty, to protect your CPNI. We may use certain information regarding your account and Services we provide in order to develop and alert you to offers of additional Services that may be of benefit to you. ACST files annual certifications with the FCC documenting our compliance with CPNI rules. In the event of a confirmed breach of CPNIACST will notify the appropriate regulatory and legal authorities as soon as it is practicable. ACST does not use CPNI data for advertising or marketing purposes. ACST does not use, disclose, share, or grant access to CPNI except as permitted or required by law. ACST is required to share CPNI data with other telecommunications providers for network operating purposes. For example, if you decide to sign up for another phone provider, your relevant CPNI data would automatically be shared with the new provider. ACST uses telecommunications provider industry-accepted technologies to safeguard CPNI data. Under federal law, you have the right, and we have the duty, to protect your CPNI. We may use certain information regarding your account and Services we provide in order to develop and alert you to offers of additional Services or products that may be of benefit to you. ACST files annual certifications with the FCC documenting our compliance with the CPNI rules (codified at 47 CFR § 64.2001 et seq).

Children’s Online Privacy Protection Act (COPPA)

ACST is committed to the safe protection of your children online and we adhere to the COPPA Act to the best of our ability. Our Websites and web-based Services are intended to help churches, schools, and other organizations fulfill their missions. They are not intended for, and should not be used by, anyone under the age of 13.

We are not responsible for the way Customers use our Services, nor are we responsible for their content. Anytime you use our Websites or Services, you represent that you are at least 13 years old. Customers must ensure that anyone using our Services is over 13 years old. It is the responsibility of each Customer to inform parents and legal guardians if any child’s data is obtained for use and to honor any opt-out requests.

Updates to Privacy Policy

We update this Privacy Policy when necessary, and it’s your responsibility to check this page periodically. We will always note the date it was last revised at the top of the policy. Changes take effect immediately upon posting. When this policy changes significantly, we will make reasonable efforts to notify our Customers of those changes.

Compliance with Laws

ACST produces software, images, videos, typefaces, graphics, music, sounds and other material (collectively “ACST Intellectual Property and Content”) we produce and we have a great deal of respect for content that belongs to others. ACST is obligated to disclose any content or electronic communication of any kind (a) to satisfy any law, regulation or government request; (b) if such disclosure is necessary or appropriate to operate the Services; or (c) to protect the rights, data, or content on the Websites and Services, belonging to you or to our providers.

When using our Services to store data, you are solely responsible for the content of that data. Your use of our Services is subject to all applicable local, state, national, and international laws and regulations. You will:

  1. not use our Services for any illegal purposes;
  2. not use our Services to store, retrieve, transmit or view any Prohibited Content;
  3. not use our Services to send any spam, chain letters or otherwise disrupt the Services or the networks through which you access and use the Services;
  4. comply with United States and other applicable laws regarding the exportation and re-exportation of any data or other materials from the United States or other jurisdictions through our Services;
  5. comply with all regulations, policies, and procedures of networks through which you access and use our Services.

ACST may use automated procedures to detect unacceptable use and may immediately disable any offending accounts.

Online Conduct

ACST has the right, but is not obligated to monitor all conduct and content on our Services and Websites. When you use our Web-based and mobile Services to communicate with others, ACST expects you to behave in a way that positively reflects your organization. We also expect that you encourage a safe, respectful environment. Posting or sharing content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, profane, hateful, racist, or that demonstrates religious discrimination is prohibited.

We reserve the right to remove communication or content that we deem to be harmful to others or violates any laws. We may also investigate allegations that violate the expectations of your conduct online. ACST, nor any of our providers can ensure prompt removal of questionable content after it has been posted online. Accordingly, ACST does not assume liability for any action or inaction with respect to conduct, communication, or content on our Services.

Likewise, if you’re using a chat feature or providing feedback on our Websites, we expect that you communicate with civility and respect. If ACST determines that any Customer has violated any law, or is using our Services in violation of these Terms, we may suspend or prohibit them from using our Services.

ACST also prohibits the following while using our Services:

  • unauthorized use of copyrighted pictures, materials or information;

  • harassing, libelous, abusive, threatening, harmful, vulgar, pornographic, obscene or otherwise objectionable material of any kind or nature; material that encourages conduct that could constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law or regulation;

  • code or material that violates the intellectual property rights of others;

  • temporary files of any kind (including, without limitation, any *.p or ~*.* files); or viruses, worms, “Trojan horses” or any other similar contaminating or destructive features.

ACST considers any and all of the above content to be prohibited (“Prohibited Content”).

We expect that you communicate with civility and respect while using our Services. If ACST determines that any Customer has violated any law, or is using our Services in violation of these Terms, we may suspend or prohibit them from using our Services.

Be Considerate of Others

Anything that you post on certain Services may become available for public consumption.

  • Do not copy or use someone else’s personally identifiable information (“PII”) without their permission.

    PII is information that can be used on its own or with other information to identify, contact, or locate someone else. PII has different definitions based on the state law or federal regulation.   • Carefully consider sharing sensitive information about others.

    Sensitive information can include many things, but think of it as being detailed in a prayer request or a post about a recent death. If you don’t have permission to share that information, don’t. Some people may not want certain, personal or sensitive information to be broadcast. Be considerate and ask for consent before posting anything that involves someone else.

Using our Mobile Solutions and Apps

All of our mobile solutions require a compatible mobile device, ACST software, Internet, and/or network access. You understand and agree that you’re responsible for meeting these requirements. ACST mobile apps are available for download on iTunes® and Google Play®. Most ACST apps are free to download if you have authorized access to ACST software. Our mobile apps will work with the software programs indicated, according to the system requirements noted. All mobile apps use data, and therefore, using ACST mobile apps will affect your data usage and costs with your mobile provider. ACST is not responsible for any fees related to usage of your mobile device.

ACST is obligated to inform you about changes or other events that may affect how you use our Services. In those times, we will notify you via online and/or mobile alerts. If an alert is mandatory, we do not allow you to “turn it off”, but you may opt out of receiving any voluntary communications we send.

Limitation of Liability and Force Majeure

We want you to enjoy using our Services; however, Internet availability and outages may cause interruptions to your service. We do not provide warranties of any kind, either express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. We offer our Services on an “as is” and “as available” basis, to the maximum extent permitted by law.

ACST won’t be held liable for any delays or failure in performance of any part of our Services, from any cause beyond our control. This includes, but is not limited to, acts of God, changes to law or regulations, embargoes, war, terrorist acts, riots, fires, earthquakes, nuclear accidents, floods, strikes, power blackouts, volcanic action, unusually severe weather conditions, and/or malicious acts of hackers.

Our Services may contain links to other, unrelated external sites. ACST is not responsible for the content those websites contain. Visiting these other websites is at your own risk.

Financial Transactions

ACST provides ways for you to register for paid events, tithe, donate, purchase training courses, or pay your monthly subscription for our Services. When you initiate a financial transaction, in general the following steps take place:

  1. You may initiate payment through a secure wire transfer payment using ACH (via a U.S. bank account) or PAD (via a Canadian bank account), or with a credit card.
  2. Once a one-time or recurring payment is set up, you’ve authorized an electronic transfer of funds from your bank account or credit card in the amount you specify.
  3. ACST, and/or an authorized agent, intermediary, or ACST partner, will obtain the funds per your instructions by debiting a bank account or charging a credit card that you designate.
  4. Your bank account or credit card statement will keep a record of the transaction(s), indicating the name of the designated recipient.
  5. We use strong encryption to protect sensitive information and we will only transfer funds from your bank account or credit card with your authorization.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will only receive text messages if you initiate communication. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. Carriers are not liable for delayed or undelivered messages.

Handling Sensitive Credit Card Data

When any organization handles payment card data, they’re required to be in compliance with the PCI Data Security Standards (“PCI DSS”). As such, ACST has met the criteria for PCI compliance and will adhere to PCI DSS requirements with regard to access and use of cardholder data. Likewise, Customers who accept payment cards using our eGiving Services are also required to comply with PCI and complete an annual PCI security questionnaire. For more information about PCI and your responsibilities, visit our PCI Frequently Asked Questions.

Export Clause

The United States export control laws regulate the export and re-export of technology originating in the United States. This includes the electronic transmission of information and software to foreign countries and to certain foreign nationals. The Customer agrees to abide by these laws and their regulations—including but not limited to the Export Administration Act and the Arms Export Control Act and not to transfer, by electronic transmission or otherwise, any Content derived from the Sites to either a foreign national or a foreign destination in violation of such laws.

Governing Law and Severability

Any dispute involving ACST will be governed by the laws of the State of South Carolina under the exclusive jurisdiction of the state and federal courts located in Florence County, South Carolina, where our headquarters are located.

These Terms prohibit you from transferring, assigning, or otherwise delegating any rights or obligations of your account to another person or entity. Conversely, under these Terms, we may assign our respective rights and obligations without notice or consent. This may be in connection with a merger, consolidation, reorganization, or sale of our respective, related assets or similar transaction. The provisions of these Terms are intended to be severable. If for any reason one provision is held invalid or unenforceable, the remainder of the provisions are held separate and still apply.

Term and Termination

When the Customer determines that Services are no longer needed, the term will continue until the end of the current Billing Period and the Agreement is terminated.

To cancel this Agreement, please call 1-800-736-7425. You must be authorized to make account changes and are responsible for paying any outstanding payments. You will be requested to complete a brief exit interview before terminating this Agreement.

You agree that ACST may terminate or suspend your account and access to the Services in the event of any of the following: (a) breach or violation of this Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other governmental agencies, (c) request by you, or (d) failure to pay any fees owed for the Services.

Upon termination: (a) we have no obligation to provide any Services after the effective date of the termination; (b) you will immediately pay to us any fees and other amounts that have accrued prior to the effective date of the termination; and (c) any and all liabilities accrued prior to the effective date of the termination will survive. All provisions of this Agreement which by their nature extend beyond the expiration or termination of this Agreement shall survive the termination or expiration of this Agreement.
